A Chapter 13 bankruptcy is commonly called a reorganization. That is
because the debtor enters into a payment plan to pay back a portion of
the debts owed to creditors. The payment plan can last up to 5 years.
The advantage to filing a Chapter 13 bankruptcy is that the debtor is able
to keep all of his assets, whether they are exempt or not. Some debts
that cannot be discharged in a Chapter 7 bankruptcy can be reduced in
Chapter 13 payment plan.
Additionally, any co-signers to your debts are immune from the creditor’s
collection activities so long as the Chapter 13 plan provides for full
payment.
You can also receive protection against foreclosure by your lender of
your home.
Some disadvantages to filing a Chapter 13 bankruptcy is that you must pay
your debts out of your disposable (post-bankruptcy) income. This ties up
your cash over the repayment period.
